Withdrawal Policy

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), take possession of the last item of goods. To exercise your right of withdrawal, you must inform us (Spearfishing Shop, Bitzenstr. 24, 67269 Grünstadt, Germany, Tel. +49 6359 87 277 97, Email: info@spearfishing.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. This contract has been received by us. For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us.

The deadline is met if you send back the goods before the period of fourteen days has expired. The customer have to bear the costs of the return.

Returns or exchanges are only possible if the goods are undamaged, unused and in their original packaging.

No shipping costs will be refunded in the case of a partial return!

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. The right of withdrawal does not apply to goods whose properties and functionality are not attributable to handling them beyond what is necessary.

Exclusion of the Right of Withdrawal

According to Section 312g Paragraph 2 of the German Civil Code (BGB), the right of withdrawal does not apply to distance contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. If the returned goods were damaged due to the fault of the consumer, the retailer is entitled to compensation for the diminished value, the amount of which will be determined individually.
